Clients will decide the general direction of their matter. Lawyer will provide legal advice and services necessary to carry out client’s instructions. Lawyer’s advice tends to focus on the different options available to move client’s matter forward, including the pros, cons and costs associated with each option. Lawyer can advise and recommend, but the final decision comes from the client. While advising, lawyers can not accept instructions that are substantially or materially in conflict with their duties to the courts, other lawyers or the public.
At NJ PLC we believe in two-way traffic to establish an effective lawyer-client relationship. Emails are always our preferred way of communication to provide updates to our clients. However, we also use phones/skype/video calls depending on specific circumstances. We ask that our clients also respond to our emails or phone calls in a timely fashion. Our preferred language is English. However, we use Bengali, Hindi and basic American Sign as well. We also have a pool of interpreters and translators.
Our lawyer and the legal team has more than 25 years of practicing experience in Bangladesh. Through their experienced law chamber in Bangladesh, they can provide advice and litigation services to Bangladeshi Canadians residing in Canada on various topics such as property, guardianship, divorce, power of attorney, succession certificates, personal and financial issues that need to be dealt with by the Courts of Bangladesh. Our team can facilitate the Bangladeshi Canadians with legal advice from our Toronto office on matters related to Bangladesh.
Lawyers have a duty to keep client information confidential at any time, regardless of the source of the information for an indefinite period. A lawyer may not disclose such except as authorized or required by the Rules or other law.
To retain a lawyer means to hire a lawyer to assist client in their legal matter upon a consideration and certain terms. Once a lawyer has been retained by the client, lawyer will provide client with a retainer letter, which sets out the matter and details of the lawyer-client relationship. This includes how client will be invoiced for legal services, disbursements and communicated and also give assurance of confidentiality of client information. At NJLPC once retained, we perform legal services on your behalf and provide a statement of account for those services. If your matter is resolved and there are still retainer funds being held in trust for you, the remaining funds will be returned to you.
We maintain a separate bank account for money we hold in trust for our clients, designated as a trust account. The Law Society of Ontario has very strict standards for lawyers’ trust accounts. Trust accounts are audited annually by a professional accountant and the results of the audit are reported to the Law Society. The Law Society also conducts spot audits. In most cases, the interest on trust accounts goes to the Law Foundation of Ontario and is used for law reform and public legal education.
Lawyers’ fees are mostly based on experience and time spent to resolve your matter. There are also other factors that come into play, such as the importance of issues, the amount involved, the complexity of the proceeding, and the results achieved.
